The Fair Housing Act

The Fair Housing Act (42 U.S.C. §§ 3601–3619) is a federal law that prohibits discrimination in the sale, rental, and financing of housing based on protected characteristics. It applies to most housing and to a wide range of housing-related activities including advertising, real estate brokerage, appraisal, and mortgage lending.

The Act makes it unlawful to:

  • Refuse to sell, rent, or negotiate with any person based on a protected characteristic.
  • Set different terms, conditions, or privileges for sale or rental of a dwelling.
  • Advertise or make any statement that indicates a limitation or preference based on a protected characteristic.
  • Deny that housing is available for inspection, sale, or rental when it is actually available.
  • Engage in blockbusting, steering, or redlining practices.
  • Deny access to, or membership in, any multiple listing service or other organization related to the sale or rental of housing.
  • Coerce, intimidate, threaten, or interfere with anyone exercising a fair housing right or assisting others who exercise that right.

Protected Classes

Under federal law, housing discrimination is prohibited on the basis of the following protected classes:

The State of Arizona and many local municipalities provide additional protections beyond federal law. Arizona's fair housing laws extend to additional characteristics including source of income in some jurisdictions. “Familial status” includes households with children under the age of 18 living with a parent or legal guardian, and pregnant women. “Disability” includes physical and mental impairments that substantially limit one or more major life activities.

  • Ensures that all marketing materials, including photography, language, and digital advertising, comply with fair housing guidelines and do not express or imply a preference for any protected class.
  • Provides reasonable accommodations and modifications for persons with disabilities as required by law.
  • Conducts periodic fair housing training for all agents and staff.

How to File a Complaint

If you believe you have experienced housing discrimination, you have the right to file a complaint. Complaints may be filed with the following agencies:

U.S. Department of Housing and Urban Development (HUD)

File online, by phone, or in person. HUD investigates complaints of housing discrimination under the Fair Housing Act at no cost to you.

Arizona Department of Housing (ADOH)

Arizona residents may also file a complaint with the state housing agency.

Arizona Department of Real Estate (ADRE)

Complaints about licensed real estate professionals may be filed with the Arizona Department of Real Estate.

Fair housing complaints must generally be filed within one year of the alleged discriminatory act. Retaliation against anyone who files a fair housing complaint is illegal.
